Terms of Service

Beauty Web Retail specializes in the design, development, hosting, maintenance, and support of professional Shopify eCommerce websites for retail businesses.

Your website subscription includes ongoing technical support and access to our team for assistance with website maintenance, troubleshooting, approved content updates, promotional graphics, app integrations, product feed assistance, discount creation, and other services included in your selected website plan.

Website Management

Your subscription may include:

• Website hosting and maintenance
• Technical support
• Promotional graphic updates based on your selected plan
• App integrations
• Product feed assistance
• Discount and promotional setup
• Email automation support
• General website assistance

Additional services requested outside the scope of your selected plan may be quoted separately.

Intellectual Property

All website designs, layouts, themes, graphics, templates, custom programming, and proprietary systems developed by Beauty Web Retail remain the intellectual property of Beauty Web Retail unless otherwise agreed to in writing.

Clients retain ownership of their business name, logo, trademarks, product information, images, and any original content they provide.

Client Responsibilities

The client agrees to provide accurate business information, product data, pricing, images, policies, logos, and any other materials necessary to complete the website.

The client certifies that all submitted content is owned by them or properly licensed for commercial use.

Billing

Monthly billing will begin on the earlier of:

• The date the website is published and made live; or
• Thirty (30) days after the project officially begins.

Subscription payments will automatically recur according to the selected billing schedule.

Subscription Agreement

A minimum twelve (12) month service agreement is required.

Written notice of cancellation must be provided at least thirty (30) days before the next billing cycle.

Subscriptions automatically renew unless proper cancellation notice is received.

Upon cancellation, all hosting, maintenance, support, updates, and subscription services will end.

Any outstanding balances become immediately due upon termination.

Website setup fees, development fees, licensing fees, and previous subscription payments are non-refundable.

Limitation of Liability

Beauty Web Retail does not guarantee specific search engine rankings, website traffic, customer inquiries, online sales, or business profitability.

Our total liability for any claim shall not exceed the amount paid by the client during the one (1) month immediately preceding the claim.

Indemnification

The client agrees to defend, indemnify, and hold Beauty Web Retail harmless from any claims, damages, liabilities, legal expenses, or losses arising from:

• Client-provided content
• Products or services sold by the client
• Copyright or trademark infringement
• Regulatory or legal compliance issues
• Operation or use of the client's website

Legal & Compliance Disclaimer

Beauty Web Retail provides website development, hosting, maintenance, and related digital services.

The client is solely responsible for ensuring compliance with all applicable federal, state, local, and industry-specific laws, regulations, tax requirements, licensing obligations, consumer protection laws, privacy regulations, accessibility standards including ADA requirements, and any other legal requirements applicable to their business.

While Beauty Web Retail may assist with requested updates, we do not provide legal, tax, accounting, or regulatory advice and do not monitor or guarantee ongoing compliance.

Website accessibility standards and regulations continue to evolve. Clients with specific compliance requirements should consult with qualified legal counsel or an accessibility compliance specialist.

Beauty Web Retail shall not be responsible for any fines, penalties, lawsuits, regulatory actions, losses, or damages resulting from the client's failure to comply with applicable laws or regulations.

Client Authorization

By checking the agreement box below, I acknowledge that I have read, understood, and agree to the Beauty Web Retail Terms of Service and authorize Beauty Web Retail to begin development of my website in accordance with the selected website package and service agreement.
